1. AGREEMENT TO THESE TERMS
These Terms of Service govern your use of the website and services of 78 Ventures, Inc. ("78 Ventures," "we," "us," or "our"), a New York corporation. By using our website, submitting an application, or participating in our text messaging program, you agree to these terms. If you do not agree, please do not use our services.
2. OUR SERVICES
78 Ventures provides per-diem and contract nurse staffing services to long-term care and skilled nursing facilities. We recruit, credential, and place licensed and certified clinicians on assignment with client facilities.
Submitting an application does not create an employment relationship and does not guarantee placement on any assignment. Placement depends on credentialing, client requirements, and shift availability.
3. TEXT MESSAGING PROGRAM
What you will receive
If you opt in, 78 Ventures will send you text messages about open shifts, schedule confirmations and changes, credentialing and document expiration reminders, and assignment details.
How to opt in
You may opt in by:
• Entering your mobile number and checking the SMS consent box on our clinician application form; or
• Texting our published keyword to our program number.
Consent is not a condition of employment, placement, or any purchase. You may apply and be placed without agreeing to receive text messages.
How to opt out
Reply STOP to any message at any time. You will receive a single confirmation and no further messages. To rejoin, reply START.

Cost
78 Ventures does not charge for these messages. Message frequency varies; you may receive up to 15 messages per month. Message and data rates may apply under your mobile plan. Contact your wireless provider for details about your plan.
Carriers and delivery
Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Cricket, and others. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your wireless provider and is outside our control.
Changing your number
You agree to notify us if you change or deactivate the mobile number you gave us, so that messages intended for you are not sent to someone else.
4. ELIGIBILITY
You must be at least 18 years old and hold a current, unrestricted license or certification in the state of assignment to apply for placement through 78 Ventures.
5. INFORMATION YOU PROVIDE
You agree that all information you submit — including license numbers, certifications, work history, immunization records, and availability — is accurate, current, and complete. Providing false or misleading credentialing information may result in removal from assignment and termination of your relationship with 78 Ventures, and may be reported as required by law or professional licensing rules.
6. ACCEPTABLE USE
You agree not to use our website or services to transmit unlawful, harassing, or fraudulent content, to attempt to gain unauthorized access to our systems, or to interfere with the operation of our services.
7. INTELLECTUAL PROPERTY
The content, layout, and materials on this website are owned by 78 Ventures, Inc. and may not be reproduced or distributed without our written permission, other than for your personal, non-commercial reference.
8. DISCLAIMERS
Our website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted or error-free, or that any assignment will be available to you.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, 78 Ventures, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our website or text messaging program, including any delayed or undelivered message.
10. GOVERNING LAW
These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising under these terms will be brought in the state or federal courts located in New York.
